I. Einleitung

This Acceptable Use Policy (“AUP”) governs your access and use of any Panopto products, software, platforms, and services (the “Panopto Services”). An organization or other third party, which is Panopto’s “Customer,” has entered into a written agreement with Panopto for the Panopto Services (the “Contract”) and has given you access to use the Panopto Services pursuant to the Contract. You, along with others in your organization, are each an “Authorized User.” The Contract contains Panopto’s commitment to deliver the Panopto Services to Customer, who may then invite Authorized Users to access and use the Panopto Services. This AUP applies to you as an Authorized User, and Customer is responsible to ensure your compliance with this AUP. This AUP may change as our business evolves, so please check back regularly for updates and revisions.

When an Authorized User (including you) submits videos and other forms of media, audio, presentation material, and other content, data, or information to the Panopto Services (“User Content”), you acknowledge and agree that the Contract provides Customer with many choices and control over the User Content and the Authorized Users. For example, Customer may provision or deprovision access to the Panopto Services for an Authorized User, enable or disable third party integrations, or manage permissions, retention, and export settings, and these choices and instructions may result in the access, use, disclosure, modification, or deletion of certain or all User Content.

As between Panopto and Customer, you acknowledge and agree that it is solely Customer’s responsibility to (1) inform you and all other Authorized Users of any relevant Customer policies and practices and any settings that may impact the processing of User Content, (2) obtain any rights, permissions, or consents from you and all other Authorized Users that are necessary for the lawful use of the User Content and the operation of the Panopto Services, (3) ensure that the transfer and processing of User Content under the Contract is lawful, and (4) respond to and resolve any dispute with you and all other Authorized Users relating to or based on the User Content, the Panopto Services, or Customer’s failure to fulfill its obligations under the Contract. Panopto is not responsible or liable for the User Content, and the decision to create or access User Content or engage with other Authorized Users is yours alone.

II. Verhalten bei der Nutzung der Panopto

Im Folgenden finden Sie eine Liste akzeptabler und inakzeptabler Verhaltensweisen bei der Nutzung der Panopto .

Machen:

  • die Bedingungen dieser AUP einzuhalten
  • alle geltenden Gesetze und Vorschriften einhalten
  • Nur Benutzerinhalte einstellen und verbreiten, die Ihnen oder dem Kunden gehören oder für die Sie die erforderliche Lizenz oder das Recht zur Nutzung haben
  • Einholung aller erforderlichen Genehmigungen und Zustimmungen in Bezug auf die Erstellung, Verwendung und Verbreitung von Benutzerinhalten
  • Geben Sie bei der Erstellung Ihres Kontos korrekte und vollständige Informationen an
  • Bewahren Sie Ihr Kontopasswort und alle anderen Anmeldeinformationen vertraulich und sicher auf.
  • Überwachung und Kontrolle aller über Ihr Konto durchgeführten Aktivitäten
  • Benachrichtigen Sie Panopto unverzüglich, Panopto Sie Kenntnis von illegalen oder unbefugten Aktivitäten oder einer Sicherheitsverletzung in Bezug auf Ihr Konto erhalten oder einen begründeten Verdacht darauf haben.
  • Befolgen Sie alle geltenden Bedingungen von Anwendungen Dritter, die der Kunde in die Panopto integrieren möchte.

Lassen Sie es:

  • Dritten, die keine autorisierten Benutzer sind, den Zugriff auf oder die Nutzung der Panopto gestatten
  • ein für Sie bestimmtes Konto mit einer anderen Person zu teilen, zu übertragen oder ihr anderweitig Zugang zu verschaffen
  • Verwenden Sie die Panopto nicht zum Speichern oder Übertragen von Benutzerinhalten, die Marken, Patente, Urheberrechte, Geschäftsgeheimnisse, Persönlichkeitsrechte, Publizitätsrechte oder andere Rechte an geistigem Eigentum anderer verletzen, missbrauchen oder widerrechtlich verwenden oder die unerlaubt oder rechtswidrig sein könnten.
  • Submit User Content that is fraudulent, false, misleading, deceptive, obscene, unlawful, defamatory, libelous, inflammatory, discriminatory, abusive, harassing, threatening, hateful, violent, hostile, pornographic, indecent, or offensive, encourages conduct that would be considered a criminal offense, violate any law, or give rise to civil liability, or is otherwise inappropriate
  • Use the Panopto Services to conduct any illegal activities, such as fraud or financial crimes, money laundering, terrorism, extremist activities, illicit trafficking, or smuggling

  • Impersonate any person or entity, including without limitation another Authorized User, without their express consent, or falsely state or otherwise misrepresent your affiliation with a person, organization, or entity

  • Hochladen oder Übertragen von Daten, Dateien, Software oder Links auf die Panopto , die Viren, Trojaner, Würmer oder andere schädliche Komponenten enthalten oder zu diesen weiterleiten, oder von Technologien, die unrechtmäßig auf Inhalte oder Informationen zugreifen oder diese herunterladen, die in den Panopto oder auf der Hardware von Panopto Dritten gespeichert sind.
  • Attempt to prove, scan or test the vulnerability of any Panopto system or network or breach any security or authentication measures
  • Kopieren, modifizieren, dekompilieren, disassemblieren, zurückentwickeln, entschlüsseln, anpassen oder auf andere Weise versuchen, Softwarekomponenten der Panopto abzuleiten oder Zugriff darauf zu erlangen.
  • Attack the Panopto Services via a denial-of-service attack or a distributed denial-of-service attack or otherwise attempt to interfere with the proper working of the Panopto Services through the use of any device, software, routine, or other means
  • Attempt to gain unauthorized access to the Panopto Services or related systems or networks or to defeat, avoid, bypass, remove, deactivate, or otherwise circumvent any software protection or monitoring mechanisms of the Panopto Services
  • Zugriff auf die Panopto oder Ermächtigung anderer Personen zum Zugriff auf die Panopto aus einem Land, gegen das ein Embargo verhängt wurde, unter Verstoß gegen geltende Wirtschafts- und Handelssanktionen

  • Access the Panopto Services in order to build a similar or competitive product or service, copy any ideas, features, functions, logos, designs, graphics, branding, marks, or any other materials used in the Panopto Services, engage in any benchmarking, or provide access to the Panopto Services to a competitor of Panopto
  • Verwenden Sie den Panopto oder andere von den Panopto bereitgestellte Tools für einen der folgenden kommerziellen Zwecke: den Verkauf des Zugangs zu den Panopto oder den Verkauf von Werbung, Sponsoring oder Werbeaktionen, die auf oder innerhalb der Panopto platziert werden.

  • Zugriff auf Benutzerinhalte über andere Technologien oder Mittel als die Panopto oder andere ausdrücklich autorisierte Mittel, Panopto benennen Panopto
  • Verwenden Sie automatisierte Systeme wie „Robots“, „Spiders“ oder „Offline-Reader“, um auf die Panopto zuzugreifen.

III. Verstöße gegen diese AUP

Panopto may, but is not required to, monitor the use of the Panopto Services for security and operational purposes, and to verify compliance with this AUP. Panopto reserves the right to decide whether User Content or your use of the Panopto Services is appropriate and complies with this AUP. If we believe that there is a violation of this AUP that can simply be remedied by Customer removing certain User Content or taking other action, we will, in most cases, ask Customer to take action rather than intervene. However, we may, at any time, without prior notice, and in our sole discretion, directly step in and take what we determine to be appropriate action (including without limitation deleting User Content or disabling or terminating your account) if Customer does not take appropriate action or we believe there is a credible risk of harm to us, the Panopto Services, Authorized Users, or any third parties.
